Cofferdam Licence Terms
The terms that govern every Cofferdam install.
Version 2026-10, in force from 21 October 2026. These terms govern every Cofferdam install: the free Community edition, the 30-day Professional trial, and paid Professional and Enterprise licences. Each version stays published at its own address.
1. About these terms
1.1 These terms are an agreement between Trificta Pty Ltd (ABN 34 644 855 158) ("Trificta", "we", "us") and the organisation that installs or uses Cofferdam ("you").
1.2 You accept these terms by accepting them when you register for a licence key, start a trial or first set up an install, or by accepting a quote or order that refers to them. If you accept them for an organisation, you confirm that you have authority to bind it. The version that applies is the one accepted when the licence was ordered or last renewed. Accepting it again when you first set up an install does not change it.
1.3 For a paid licence, your order and these terms together make the agreement. If they conflict, your order wins on price, edition, limits, term and number of installs, and these terms win on everything else. A separate agreement signed by both of us wins over both.
1.4 If you buy through a Trificta partner, you agree your price, invoicing, payment and renewal with the partner. Clauses 10.1, 10.2, 10.4, 10.5 and 10.7 then apply between you and the partner as you agree with it, not between you and us. These terms otherwise govern your licence, and any refund they give you is paid to you through the partner.
1.5 These terms cover Cofferdam installs that you, or a contractor acting for you, run on systems you control, including in a cloud account held in your name. They do not cover a Cofferdam instance that Trificta operates for you (a hosted instance). A hosted instance is covered by a separate hosted services agreement, and these terms apply to it only as far as that agreement says. We will not operate a hosted instance for you until that agreement is signed. If we help run an install in your environment, for example as part of professional services, these terms still cover the install and the services agreement covers our services.
2. Words we use
| Term | Meaning |
|---|---|
| Cofferdam | The Cofferdam software, its updates and its documentation |
| Edition | Community, Professional or Enterprise, as set by your licence key |
| Licence key | The signed key that sets your edition, limits and term |
| Install | One running copy of Cofferdam with its own database. The product calls it an instance |
| Production install | An install used for your live operations. Any other install is non-production |
| Order | A quote or order form for a paid licence that you have accepted |
| Term | The period a paid licence runs, as set out in your order |
| Beta feature | A feature labelled beta in Cofferdam or on our website |
| Your data | Everything you, your users or your systems put into Cofferdam |
| Users | People who sign in to an install, including your contractors |
3. Your licence
3.1 We grant you a non-exclusive, non-transferable licence to install and use Cofferdam for your own internal business purposes, in the edition and within the limits of your licence key, while these terms allow.
3.2 Your employees and contractors may use Cofferdam on your behalf. You are responsible for what they do with it.
3.3 A Professional or Enterprise licence covers one production install and one non-production install, unless your order or licence key says otherwise. A Community licence covers one install.
3.4 You may run a standby install for disaster recovery. While your production install is out of service, the standby may take its place without a further licence.
3.5 You may copy Cofferdam and its database for backup and disaster recovery.
3.6 Cofferdam is licensed, not sold. Every right these terms do not grant stays with Trificta.
4. Community and the trial
4.1 Community is free. It covers one site, 250 assets and 5 users, and you may use it for any internal purpose within those limits, including production.
4.2 A Community licence key does not expire. While you hold one, your install can receive the releases we publish for Community, security releases included.
4.3 We may change what a future release of Community includes. A release you already run keeps working as it is.
4.4 The trial gives one install the Professional edition for 30 days, within Professional's limits. Each install gets one trial, and it cannot be extended or started again. We may decline a trial request, for example a second trial for the same organisation.
4.5 When a trial ends, or if it is used on an install other than the one it was issued to, that install runs as Community straight away. Nothing is deleted.
4.6 Community and trial support is by ticket through our client portal, with no response-time commitment.
5. What you must not do
5.1 In this clause, Cofferdam means our own code, not the open-source components clause 12.2 describes. Except as these terms, an open-source licence or the law allow, you must not:
- copy, modify or distribute Cofferdam, other than the copies clause 3.5 allows and back-up copies the law allows;
- reverse engineer, decompile or disassemble Cofferdam, except as the law allows despite this clause. Sections 47B(3), 47C, 47D, 47E and 47F of the Copyright Act 1968 (Cth) let you do some of these things to study how Cofferdam works, make back-ups, make other software or hardware work with it, fix errors and test its security, and section 47H means this clause cannot take those rights away;
- remove, disable or work around licence keys, licence limits or edition controls in order to use Cofferdam beyond the edition, capacity or term you have licensed. Clauses 5.2, 11.6 and 12.2 say when you may work around them for other purposes;
- share a licence key with another organisation;
- sell, rent, lend or sublicense Cofferdam, or run it as a service for other organisations, unless we have agreed to that in writing;
- remove or change any copyright, licence or other proprietary notice in Cofferdam, including the notices for its open-source components.
5.2 Security testing. (a) You, or a contractor acting for you, may test the security of your own Cofferdam installs and the systems and networks they are part of, including penetration testing, vulnerability scanning and fuzzing, and analysing, decompiling or disassembling Cofferdam. (b) For that testing, and to investigate or fix a vulnerability, we give you permission to work around licence keys, licence limits and edition controls, but not to run features, capacity or time you have not licensed. (c) This does not cover systems we operate, such as our licence service, update service or client portal. Do not test those without our written permission. (d) Please report any vulnerability you find through our client portal. We will acknowledge it within 5 business days. (e) You may share your findings with your contractors, auditors, insurers and regulators, and publish them once we release a fix or 90 days after you reported them, whichever is sooner. This is our consent for section 47G of the Copyright Act 1968 (Cth).
6. Licence keys, limits and the licence check-in
6.1 Cofferdam checks your licence key on the install itself. A licence never stops Cofferdam running: an install with no key runs as Community, without updates, and nothing is deleted.
6.2 Each edition limits the number of sites, assets and users. Where a limit is 10 or more, Cofferdam allows 10% more, rounded down. Past that, adding more is refused until you buy more capacity or remove items. Nothing already recorded is touched, and limits of less than 10 have no headroom. The first administrator account, and a recovery administrator set from the deployment, are never refused, even above the user limit.
6.3 Use beyond your licence. (a) If your use goes beyond your licence, you will, within 30 days of becoming aware of it or of our notice, either order enough capacity to cover it or reduce your use to what your licence allows. (b) Added capacity is priced at the rate in your current order or, if it has none, our published price list in force at the start of your current term, and runs to the end of that term. (c) For the time before you order or reduce, you will pay for the excess pro rata from the date it began, at the same rate. If neither of us can show when it began, it is taken to have begun on the date of your last certificate under clause 6.6, or 12 months earlier, whichever is later. (d) If a verification under clause 6.6 shows use more than 5% above your licence, you will also pay our reasonable verification costs; otherwise we bear them.
6.4 A paid install with a licence key connects to our licence service, hourly unless set otherwise. It sends the key, an identifier for the install, the version it runs, whether it is a production or non-production install, and the number of sites it monitors. On a paid licence other than an air-gapped one, this check-in cannot be switched off. If the check-in cannot reach us, the install keeps working on its key.
6.5 A Community install connects only to check for updates. It sends its key and the version it runs, and an administrator can switch the check off.
6.6 Air-gapped Enterprise licences. (a) An Enterprise licence can be air-gapped. Each install needs a one-time activation, which we issue from a request code the install shows, up to the number of installs your licence allows. After that it needs no check-in, and it still ends at the end of its term. (b) Within 30 days after each anniversary of your licence start date, an authorised officer of yours (a director, company secretary or executive with authority to bind you) will give us a signed certificate stating, for each install, its install ID, whether it is production or non-production, and the highest number of sites, assets and users it had at any time in the previous 12 months. If you need more time for operational or security reasons, tell us before the due date and we will allow up to 30 more days. (c) If the certificate is still not given 30 days after our written reminder, we may hold back new activations, updates and support until it is. This does not affect installs already running. (d) No more than once in any 12 months, and only if a certificate is late or we have reasonable grounds to doubt it, we may verify your use on at least 30 days' notice, by remote session or a visit during business hours. The person doing it will follow your site security rules, hold any clearance you reasonably require, and keep what they learn confidential. (e) If a certificate or verification shows use beyond your licence, clause 6.3 applies.
6.7 Our Privacy Policy describes what we record from check-ins and update checks, and how long we keep it.
7. Updates, support and beta features
7.1 While your paid licence is in force, you receive the releases your licence key allows, security releases included. A key may set a latest version or an end date for updates, but during a paid term it will not stop you receiving a release that fixes a defect under clause 13.3. After a paid licence ends, you keep the releases published while it was in force.
7.2 Support depends on your edition:
| Edition | Support |
|---|---|
| Community and trial | Tickets through our client portal, with no response-time commitment |
| Professional | Tickets during business hours (8 am to 6 pm Brisbane time, Monday to Friday, excluding Queensland public holidays), with a response within one business day |
| Enterprise | 24/7 for priority-one incidents under the service level agreement in your order, with a named contact |
7.3 We support the latest release. Fixes, security fixes included, go into the next release rather than into older ones, so to fix a problem we may ask you to upgrade.
7.4 Beta features are for evaluation. They may change or be withdrawn, response-time commitments do not apply to them, and you should not rely on them where a failure could cause harm. To the extent the law allows, we provide beta features as they are.
7.5 Some features use services run by others, under those services' own terms. By default, maps load tiles from OpenStreetMap in the user's browser, so OpenStreetMap receives that user's IP address. You can point maps at your own tile server instead. Other services, such as vulnerability feeds and the integrations you configure, are off on a new install and connect only once an administrator switches them on. We are not responsible for services we do not run.
8. Changes Cofferdam makes to your devices
8.1 Some features change your devices and systems, including configuration write-back, PLC write-back and secure remote access. Cofferdam makes those changes only as your users set them up, start or approve them.
8.2 You decide what changes are made. You are responsible for your own change control, testing and approvals, and for keeping backups of device configurations.
8.3 Cofferdam is not a safety system. Do not use it as the only protection for people, plant or the environment, and use PLC write-back only within your own engineering and safety procedures.
9. Your data and privacy
9.1 Your data belongs to you. An install you run yourself keeps it on your own infrastructure. Nothing in Cofferdam routes your data through Trificta, so we cannot see it, except as clauses 6.4, 6.5 and 9.2 describe.
9.2 What data reaches us. (a) We receive data from you only through: (i) licence check-ins, which send the licence key, install ID, version, production or non-production role and number of monitored sites, and we record the network address and time of each; (ii) activation requests for air-gapped installs; (iii) support requests and files you give us; and (iv) feedback reports, if one of your administrators switches feedback forwarding on. Feedback forwarding sends what a user types, the page address, any screenshots they attach, who sent it, the version, and your customer and install identifiers. We also hold the account and contact details you give us to buy and manage licences. (b) We use what we receive to license, support, secure and improve Cofferdam, to meet our legal obligations and to enforce these terms. We do not sell it, and we do not use feedback or support content for marketing or to train AI models without your written agreement. (c) We keep what we receive confidential and protect it with reasonable technical and organisational measures. We share it only with our staff, with the service providers we use to run licensing and support (such as email, file storage, backup and staff notification services, some of them based outside Australia), each receiving only what it needs, or where the law requires. (d) Our support system deletes screenshots and attachments 90 days after they are uploaded, except documents we must keep, such as signed orders. Copies can remain for longer in emails you send us and in our backups. (e) We handle personal information as our Privacy Policy describes. (f) Before switching feedback forwarding on, you will tell your users what it sends and to whom. You are responsible for having the right to send us what you send.
9.3 You are responsible for backing up your installs. Cofferdam includes backup tools to help.
10. Fees, renewal and refunds
10.1 Fees for a paid licence are set out in your order, in Australian dollars and excluding GST. We add GST where it applies.
10.2 We invoice at the start of each term, and invoices are due within 30 days.
10.3 We issue your licence key when you accept your order, not when you pay.
10.4 A paid licence runs for 12 months unless your order says otherwise. It then renews automatically for another 12 months, unless you turn renewal off, in the client portal or by email to sales@trificta.com.au, at least 30 days before the renewal date, or we tell you at least 90 days before the renewal date that we will not renew.
10.5 At least 60 days before the renewal date, we will send your billing and administrator contacts a renewal notice giving the renewal price, a plain summary of any update to these terms that would apply from renewal, the last day to turn renewal off and how to do it, and any lower-priced edition or option available to you. We will also email you a reminder at least 14 days before that last day. If we do not send the renewal notice in time, the licence renews at the price you currently pay. If we do not send the notice or the reminder on time, you may also end the renewed licence by notice within 30 days after the renewal date, and we will refund the renewal fee in full.
10.6 Fees are not refundable, except: (a) where the Australian Consumer Law or another law gives you a refund, which these terms do not limit; (b) where clause 10.5 gives you a refund of the renewal fee; or (c) if you end a paid licence under clause 11.1 because of our breach or an Insolvency Event affecting us, under clause 13.3 because we could not fix a defect, or under clause 14.2 because of a change to these terms. In case (c) we refund the fees you prepaid for the rest of the term, calculated daily.
10.7 If an invoice is more than 30 days overdue and you have not disputed it in good faith, by telling us in writing with your reasons, we may give you at least 14 days' notice and then stop your paid licence key. Clause 11.3 then applies. Once you pay, we will issue a new key within two business days.
11. Ending a licence
11.1 Either of us may end a paid licence by notice if the other materially breaches these terms and does not fix the breach within 30 days after receiving notice describing it. Either of us may also end a paid licence by notice if an Insolvency Event happens to the other, but only to the extent the law allows; this right cannot be exercised while, or for a reason for which, sections 415D, 434J, 451E or 454N of the Corporations Act 2001 (Cth) or a similar law prevent it. Insolvency Event means, for a party: a liquidator, provisional liquidator, administrator, restructuring practitioner, receiver, receiver and manager or other controller is appointed to it or any of its property; it applies for or becomes subject to a compromise or arrangement with creditors; it is unable to pay its debts as they fall due; it becomes bankrupt; it is deregistered; or anything with a substantially similar effect happens under any law.
11.2 You may stop using Cofferdam at any time. Fees for the current term stay payable, as clause 10.6 says.
11.3 When a paid licence ends, or we stop its key, the install keeps its edition for 14 days and then runs as Community. A countdown shows to every signed-in user from the first of those days. We will also email you at least 14 days before a paid licence ends, and as soon as we stop a key. After the 14 days:
- sign-in through LDAP, Active Directory, OIDC and SAML is refused and SCIM provisioning stops, while local accounts keep working;
- integrations pause, devices at sites served by remote pollers are no longer captured, PDU and UPS telemetry is not polled, and devices whose credentials are held in an external secret store cannot be captured;
- webhooks are not delivered, including alert and scheduled report webhooks;
- configuration write-back, PLC write-back and secure remote access are refused, and tenants, custom roles, topology maps, the thermal view, the vulnerability index and the compliance catalogues are locked;
- off-site backup copies are skipped, although backups are still taken and kept locally.
Capture of devices the server reaches itself, configuration tracking, alerts in Cofferdam and by email, the audit log and local accounts keep working. Your data stays, and entering a valid key brings everything back. If you remove a key yourself, the change happens at once. At critical sites, keep a local administrator account and plan for these changes.
11.4 We may stop a Community or trial licence key if you materially breach these terms and do not fix the breach within 14 days of being told about it. The install then runs as Community without updates. You may stop using and end a Community or trial licence at any time.
11.5 Clauses 5, 6.3, 9, 10, 11.3, 11.6, 12, 13 and 14, and any fees already owed, continue after a licence ends.
11.6 Continuity of Enterprise licences. (a) A Continuity Event happens if: (i) we do not issue a renewal, replacement or transfer key you are entitled to within 20 business days after you ask in writing, and do not fix that within 10 business days after you notify us under this paragraph; (ii) we stop issuing licence keys for Cofferdam or stop carrying on business, and no one has agreed in writing within 30 days to be bound by this clause; or (iii) an Insolvency Event happens to us, to the extent the law allows this paragraph to apply. (b) We grant you now, from the start of your Enterprise licence, a non-exclusive, perpetual, irrevocable and royalty-free licence to install and use the Cofferdam release you are running when a Continuity Event happens, and any earlier release you are entitled to run, within the edition and limits of your Enterprise licence at that time. You may exercise it only after a Continuity Event, and it ends only if we end your licence under clause 11.1 for your unremedied breach before then. (c) If your order includes escrow, which we offer on request at your cost, we will keep deposited with the escrow agent named in your order, under the escrow agreement, a licence key that does not expire for each of your Enterprise installs, matching your release and limits, with the source code and build material for that release. We will update the deposit within 10 business days after each renewal, upgrade or change to your limits, and after a Continuity Event you may obtain your keys from the escrow agent under that agreement. (d) After a Continuity Event you may engage the escrow agent, or another person bound by confidentiality, to do anything we must do under this clause, including installing a key for your entitlement. (e) If you cannot obtain a working key within 20 business days after a Continuity Event, clause 5.1 does not stop you, or a contractor acting for you, from removing, disabling or working around licence key checks in your copy of Cofferdam, but only as far as needed to use it as paragraph (b) allows. This is our permission for section 116AN(2) of the Copyright Act 1968 (Cth). (f) If we assign or exclusively license the intellectual property in Cofferdam, we will require the recipient to be bound by this clause.
12. Ownership, open-source components and feedback
12.1 Trificta owns Cofferdam and all intellectual property in it.
12.2 Third-party components. (a) Cofferdam includes open-source and other third-party components. Each is licensed to you by its authors under its own licence, not under these terms. (b) The software bill of materials published with each release lists the operating-system packages in the container image, with their licences, and the modules compiled into Cofferdam. We will send you a full list of components with their licences, and the copyright notices and licence text of any component, on request. (c) If these terms conflict with a component's licence, that licence prevails for that component. Nothing in these terms, including clause 5, limits a right such a licence gives you. (d) The map components in Cofferdam's web interface are licensed under the Hippocratic License 2.1, which is not an open-source licence and sets conditions on how they may be used, including conditions about human rights. (e) The container image and the offline bundle also include separate programs licensed under the GNU General Public License, such as the operating-system tools Cofferdam runs. They are not linked into Cofferdam. We will give a complete copy of the corresponding source code of any such program to anyone who asks us at sales@trificta.com.au, for no more than our cost of supplying it, for at least three years after we last distribute the release that contains it.
12.3 If you send us suggestions or ideas, we may use the ideas without any obligation to you. Any of your data or personal information in what you send, such as screenshots, stays under clause 9.2.
13. Consumer guarantees, our warranty and liability
13.1 Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or changed.
13.2 Your rights under the Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
13.3 Our warranty against defects. (a) This warranty covers each paid term of your licence. It does not cover Community or trial licences. (b) During the paid term, Cofferdam will perform materially as its documentation describes for your edition. (c) To claim, tell us about the defect during the term through our client portal at support.trificta.com.au/portal, by email to sales@trificta.com.au, or by post to the address below, with your licence number, the Cofferdam version and a description of the defect. (d) We will fix the defect or give you a workaround. If we cannot do either within a reasonable time, you may end the licence and we will refund the fees you prepaid for the rest of the term, calculated daily. (e) We bear our own costs of handling your claim. If you reasonably spend money to make a claim, send us the receipt and we will repay you within 30 days. (f) This warranty is given by:
Trificta Pty Ltd (ABN 34 644 855 158), 109 Shrapnel Road, Cannon Hill QLD 4170. Phone 07 2146 9409. Email sales@trificta.com.au.
(g) The benefits to you given by this warranty are in addition to other rights and remedies you have under a law in relation to the goods and services to which it relates.
13.4 Our only promises about Cofferdam are those in clauses 13.2 and 13.3. The consumer guarantees in clause 13.2, and your other rights under the Australian Consumer Law, apply as well and are not limited by this clause. Like all complex software, Cofferdam may contain errors, so we do not promise it will run without any interruption or error. If an error means Cofferdam does not meet a consumer guarantee or our warranty, you have the rights described in clauses 13.2 and 13.3.
13.5 Cofferdam and our support services are not of a kind ordinarily acquired for personal, domestic or household use. If we fail to meet a consumer guarantee, other than the guarantees in sections 51 to 53 of the Australian Consumer Law (title, undisturbed possession and undisclosed securities), our liability is limited, at our choice, to: (a) for the software, replacing it or supplying equivalent software, repairing it, paying the cost of replacing it or of acquiring equivalent software, or paying the cost of having it repaired; and (b) for services, supplying them again or paying the cost of having them supplied again. We will tell you in writing which we choose within 10 business days of your claim. This clause does not apply if you establish that it is not fair or reasonable for us to rely on it. It applies to Community and trial licences too.
13.6 This clause is subject to clause 13.8 and does not affect your rights under the Australian Consumer Law (clause 13.2), except as clause 13.5 lawfully limits them. Subject to that, neither of us is liable to the other for Consequential Loss. Consequential Loss means: (a) loss of profit, revenue, business, contracts, opportunity or anticipated savings; (b) loss of goodwill or damage to reputation; (c) loss, corruption or unavailability of data, including the cost of restoring it; (d) any loss that does not arise naturally, in the usual course of things, from the breach or event concerned; and (e) any other indirect loss, in each case whether the loss is direct or indirect and whether or not it was foreseeable. It does not include refunds or other amounts payable under clauses 10.6 or 13.3, fees paid for any period in which Cofferdam could not be used because of our breach, reasonable costs of mitigating loss, or liability the law does not allow to be excluded.
13.7 Subject to clause 13.8, each party's total liability under or in connection with these terms is limited to the fees paid or payable for the licence in the 12 months before the event that gave rise to the claim. For a Community or trial licence, the limit is AUD 100.
13.8 Clauses 13.6 and 13.7 do not apply to liability for failing to meet a consumer guarantee, which clause 13.5 alone deals with. They also do not limit liability that the law does not allow to be limited, liability for fraud, or liability for death or personal injury caused by negligence. They do not limit your obligation to pay fees, or your liability for wilfully or knowingly infringing our intellectual property or distributing Cofferdam without our permission.
14. Confidentiality, changes to these terms and general terms
14.1 Each of us will keep the other's non-public information confidential and use it only for this agreement. This does not cover information that is public, that the receiver already knew or developed independently, or that the law requires to be disclosed.
14.2 We may update these terms. An update applies to new licences, and to a renewal only if we told you about it in the renewal notice under clause 10.5. It does not change a term already running unless the law requires the change; if a change the law requires materially disadvantages you, you may end the licence and clause 10.6 applies. During a paid term we will not materially reduce the features of your edition, other than beta features. For Community licences, an update applies 30 days after we announce it in Cofferdam and the client portal, and you may stop using Community at any time.
14.3 Neither of us is liable for a delay or failure caused by events beyond our reasonable control. This does not excuse paying fees.
14.4 Either of us may assign these terms to anyone who takes over the business they relate to, by telling the other. Any other assignment needs the other's written consent, which will not be unreasonably withheld.
14.5 Notices are given by email: to you at the address in your order or registration, and to us at sales@trificta.com.au.
14.6 These terms are governed by the laws of Queensland. Each of us submits to the non-exclusive jurisdiction of the courts of Queensland and the Federal Court of Australia.
14.7 If a provision of these terms is invalid, it is severed and the rest continue. Not enforcing a right is not a waiver of it. These terms and your order are the entire agreement between us about Cofferdam.
14.8 Sanctions and export controls. (a) Each of us will comply with the sanctions and export control laws that apply to it in connection with Cofferdam; for us these include Australia's sanctions laws, the Defence Trade Controls Act 2012 and the Customs Act 1901. (b) You confirm that, as far as you know after reasonable enquiry, neither you nor anyone who owns or controls you is designated or listed under Australian sanctions laws, including the United Nations sanctions Australia applies. You will not install, use or give access to Cofferdam in a country or region where Australian sanctions measures would prohibit it, and you will tell us promptly if either changes. (c) You will not use Cofferdam, or let anyone use or access it, for the benefit of such a person, or for a military end use or a weapons of mass destruction program, unless the law permits it and any required permit has been granted. (d) If you move an install, or allow access to it, across a national border, you are responsible for any export or transfer permit the laws that apply to you require. On request we will tell you how we classify Cofferdam under Australia's Defence and Strategic Goods List. (e) We may refuse an order or activation, withhold updates, support or new activations, or suspend or end a licence, if we reasonably believe continuing would breach sanctions or export control laws or a permit condition, or while a permit we have applied for is pending. We will tell you as soon as the law allows. A suspended install keeps capturing the devices its own server reaches, as clause 11.3 describes. (f) If we end a licence under paragraph (e) and you have not breached this clause, we will refund the fees you prepaid for the unused period, unless the law prohibits that payment. Neither of us is liable to the other for anything this clause or the law requires it to do or not do.
